These Terms of Service ("Terms") govern your access to and use of the QwikLearn website and platform (the "Service"), operated by QwikLearn ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be able to form a binding contract in your jurisdiction to use the Service. If you are a minor, you represent that you have parental or guardian consent. You are responsible for ensuring your use complies with school, exam board, and local rules.

2. Account Registration

You agree to provide accurate information and keep your credentials secure. You are responsible for all activity under your account. Notify us promptly of unauthorized access at marckychew@gmail.com.

3. The Service

QwikLearn provides AI-assisted educational tools including tutoring, note generation, study plans, assignments, and related features. The Service is provided for educational purposes only. It is not a substitute for qualified teachers, official curricula, or professional advice.

4. AI-Generated Content Disclaimer

Content produced by AI may contain errors, omissions, or outdated information. You must verify important facts against official syllabus materials, textbooks, and instructors. We do not guarantee grades, exam results, or academic outcomes. Use AI outputs responsibly and in line with your institution's academic integrity policies.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or to violate others' rights.
  • Upload content you do not have the right to use, or that is harmful, harassing, defamatory, or infringing.
  • Attempt to cheat on exams, plagiarize assessed work, or circumvent academic integrity rules where prohibited.
  • Reverse engineer, scrape, overload, or disrupt the Service or its security measures.
  • Share account credentials or resell access without authorization.
  • Use automated means to access the Service except as we expressly permit.
  • Generate or distribute content that is illegal, sexually exploitative of minors, or promotes violence or hatred.

We may suspend or terminate accounts that violate these rules.

6. User Content

You retain ownership of content you submit. You grant us a non-exclusive, worldwide license to host, process, and display your content solely to operate and improve the Service (including sending relevant portions to AI providers as described in our Privacy Policy).

7. Credits, Billing, and Refunds

Certain features require credits or payment. Prices and credit usage are shown in the Service. Payments are processed by Stripe and subject to their terms. Unless required by law or stated otherwise at purchase, fees are non-refundable once credits are consumed or digital services are delivered. We may change pricing with reasonable notice.

8. Intellectual Property

The Service, including its design, branding, and underlying software, is owned by us or our licensors. You may not copy, modify, or distribute our materials except as allowed by these Terms or with written permission.

9. Third-Party Services

The Service integrates third-party tools (e.g. Google sign-in, payment processors, AI APIs, advertising). Your use of those features is also subject to the respective third parties' terms.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QWIKLEARN AND ITS AFFILIATES, OFFICERS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) USD $50, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

12. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your use of the Service, your content, or your violation of these Terms.

13. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms, risk to the Service, or legal requirements. Provisions that by nature should survive (disclaimers, liability limits, indemnity) will survive termination.

14. Governing Law and Disputes

These Terms are governed by the laws of Malaysia, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country require otherwise. Disputes shall be resolved in the courts of Malaysia, unless applicable law grants you the right to bring claims in your home jurisdiction.

15. Changes to Terms

We may modify these Terms by posting an updated version. Material changes will be indicated by updating the "Last updated" date. Continued use after changes constitutes acceptance where permitted by law.
